Terms and conditions
ARTICLE 1 – PURPOSE
These general terms and conditions of sale, hereinafter referred to as "GTC," define the conditions for marketing the services offered by SCX Racing, regardless of their marketing methods (online, etc.).
SCX Racing is a brand belonging to the SCX Racing association, whose registered office is located at 11 rue Basse 59800 LILLE, registered under number W595030141.
The terms "order," "training," and "session" refer to the products and services offered by SCX Racing, for which interested parties meeting the GTC described below may register.
The terms "trainees," "clients," and "users" refer to any individual or entity filling out an order form or application issued by SCX Racing in any written form.
The confirmation of an order by any written means (mail, fax, email) or online via the website implies the client’s express and unconditional acceptance of the GTC detailed in this document.
The present GTC cannot be modified except with the written consent of SCX Racing, notified to the interested party.
ARTICLE 2 – ORDER AND CONFIRMATION
SCX Racing's main activity, motorcycle circuit training, is intended for adults, as are the other services offered.
To access SCX Racing products and services, it is required to complete an application or order form accurately and thoroughly, as indicated on the form, regardless of its format (paper, file, or online form on the website scx-racing.com).
Once the order is confirmed, either by handwritten signature, scanned signature, electronic signature, or online validation, it cannot be modified.
Upon receiving your order, we will send an email confirming receipt. The order will be confirmed by SCX Racing after verifying compliance with the GTC and receiving payment, as detailed in these GTC.
SCX Racing reserves the right not to confirm an order if it does not comply with the GTC, if registration requirements are not met, or if there is a failure to make full or partial payment.
ARTICLE 3 – CONDITIONS OF PARTICIPATION
The trainee enrolled in an SCX Racing session certifies that they:
– Are of legal age.
– Hold a valid motorcycle license or a valid Certificate of Aptitude for Motorcycling Sport (CASM), issued by the French Motorcycling Federation (FFM).
– Have a valid insurance policy for their road motorcycle, along with specific coverage for circuit riding. A Circuit Pass, to be purchased independently from the FFM or its approved partners, is required to cover at least civil liability. Those holding a valid FFM training (NET) or competition (NCO) license may also participate.
– Are informed about the option to purchase additional personal insurance through the FFM license or FFM Circuit Pass.
– Have suitable equipment for circuit riding, which includes a leather suit (one- or two-piece), leather boots and gloves, an approved full-face helmet, and a back protector.
– Have a motorcycle in good condition, with tires and brake pads in excellent shape, and an exhaust system compliant with noise regulations in effect.
During the session, the trainee also agrees to:
– Respect SCX Racing’s safety instructions regarding circuit-specific regulations and signaling.
– Demonstrate respectful behavior toward other participants, their guests, SCX Racing's staff, and anyone involved in organizing the session.
– Ensure that their guests also comply with the instructions given by SCX Racing.
In case of non-compliance with these obligations, SCX Racing reserves the right to deny or suspend the trainee’s participation without any reimbursement.
ARTICLE 4 – SESSION SCHEDULE & CONFIRMATION
The session schedule published by SCX Racing is provided for informational purposes. SCX Racing may modify it at any time.
Session confirmation is made by sending the registration confirmation, subject to order compliance and payment. SCX Racing sends the confirmation no later than 48 hours before the session.
SCX Racing may cancel a session in case of unforeseen circumstances, notably for safety reasons or insufficient participants. In such a case, SCX Racing will offer an equivalent session or reimburse the order within one month.
ARTICLE 5 – MODIFICATION, CANCELLATION
Any request to modify or cancel an order must be notified in writing at least 30 days before the session. Beyond this period, no modification will be accepted, and the total amount of the order will be due. SCX Racing reserves the right to cancel any order if full payment has not been received 15 days before the session.
ARTICLE 6 – LEGAL WITHDRAWAL PERIOD
In compliance with current regulations, the client has a right of withdrawal for 7 days from the date of order confirmation, by sending a request via registered mail. SCX Racing will cancel the order and refund any amounts paid within one month.
ARTICLE 7 – PAYMENT
The client agrees to pay for the SCX Racing service as indicated on the validated order form, including any additional fees related to payment and shipping. Payment can be made online (credit card, PayPal) or by check. SCX Racing reserves the right to cancel any order if full payment has not been received 15 days before the session.
ARTICLE 8 – ACCEPTANCE OF RISK & LIMITATION OF LIABILITY
By confirming their registration, the trainee accepts the inherent risks associated with motorcycle riding on a circuit. SCX Racing cannot be held liable for any injuries or disputes. The trainee consents to on-site medical care if needed.
ARTICLE 9 – PERSONAL DATA
The client agrees to provide accurate information. Certain data fields are mandatory for registration. The client has a right of access, rectification, and objection to their data.
ARTICLE 10 – IMAGE RIGHTS TRANSFER
The trainee grants SCX Racing the right to use their image on any media (photo, video) for any use (educational, technical, advertising) without territorial limits. Guests accompanying the trainee are also informed and consent to the same image rights.
ARTICLE 11 – ENTIRETY OF THE PRESENT GTC – MODIFICATION
These GTC constitute the entire agreement of SCX Racing and replace any prior agreement. Any modification of the GTC is at SCX Racing’s sole initiative.
ARTICLE 12 – DISPUTES
In the event of a dispute, the competent courts in Paris shall have exclusive jurisdiction, notwithstanding appeal and multiple defendants.
